I.
General Provisions

The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as:“GDPR”) is JTK s.r.o., ID No. 44267827, with its registered office at Nádražní 271, Hostivice, registered in the Commercial Register maintained by the Municipal Court in Prague, file number C 7365. (hereinafter referred to as:“the controller”).

phone: +420 739 293 919- Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
- The controller has not appointed a data protection officer.
II.
Sources and Categories of Processed Personal Data
- The controller processes personal data that you have provided to it or personal data that the controller has obtained in connection with the fulfillment of your order:
- first and last name
- email address
- mailing address
- phone
- The controller processes your identification and contact information, as well as the data necessary for the performance of the contract.
III.
Legal basis and purpose of personal data processing
- The legal basis for the processing of personal data is
- compliance with the controller’s legal obligation under Article 6(1)(c) of the GDPR,
- the controller’s legitimate interest in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR
- Your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in the event that no goods or services have been ordered.
- The purpose of processing personal data is
- to process your order and to exercise the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for the successful processing of the order (name and address, contact information) is required; the provision of personal data is a necessary requirement for the conclusion and performance of the contract; without the provision of personal data, it is not possible to conclude the contract or for the controller to perform it;
- compliance with legal obligations toward the state,
- sending commercial communications and conducting other marketing activities.
- The controller engages in automated individual decision-making within the meaning of Article 22 of the GDPR. You have provided your explicit consent to such processing.
IV.
Data Retention Period
- The controller retains personal data
- for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
- for as long as consent to the processing of personal data for marketing purposes remains in effect, up to a maximum of 10 years, if personal data is processed based on consent.
- After the retention period for personal data has expired, the controller will delete the personal data.
V.
Recipients of Personal Data (the Controller’s Subcontractors)
- Recipients of personal data are persons
- involved in the delivery of goods/services/processing of payments under a contract,
- providing e-shop operation services (NetCentrik) and other services related to the operation of the e-shop,
- providing marketing services.
- The controller does not intend to transfer personal data to a third country (a country outside the EU) or to an international organization.

Personal Data Processors
- Personal data is processed by the controller; however, the following processors may also process personal data on its behalf:
- Mailchimp (US): email marketing—the data protection policy is described here.
- Google (US): behavioral and traffic analysis, online advertising—Google’sdescriptionof personal data processing can be found here.
- Upgates (CZ): e-shop solution provider—Upgates’ privacy policy is available here.
- a company providing accounting services
- or other providers of processing software, services, and applications, which the controller does not currently use.
- We may also transfer your personal data to other entities acting as data controllers, but only provided you have consented to marketing cookies in your browser (currently Google Ireland Limited, registration number 368047, with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland).
- On our website, we use conversion tracking via Google Ads, which includes enhanced conversion tracking to improve the accuracy of measured conversions. We share marketing data about our website visitors with Google to further improve the relevance of conversion tracking. This data is encrypted before being sent to ensure maximum protection. Google may match this data with its own database specifically for the purpose of refining conversion tracking. The information about our website visitors that we share with Google in this way consists of the data you enter into forms on our website, such as order or contact forms.
- We use Google Signals to personalize ads more accurately. When you consent to the processing of cookies, this functionality is automatically enabled.
- When personal data is transferred, Google becomes a joint controller; in other cases, it acts as our processor. VI.
Your Rights
- Under the conditions set forth in the GDPR, you have
- the right to access your personal data pursuant to Article 15 of the GDPR,
- the right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR,
- the right to erasure of personal data pursuant to Article 17 of the GDPR,
- the right to object to processing under Article 21 of the GDPR,
- the right to data portability under Article 20 of the GDPR, and
- the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms and conditions.
- You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to bring the matter before a court.
VII.
Terms and Conditions for Personal Data Security
- The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
- The Controller has implemented technical measures to secure data storage systems and physical storage of personal data.
- The Controller declares that only persons authorized by the Controller have access to personal data.
VIII.
Final Provisions
- By submitting an order via the online order form, you confirm that you are familiar with the terms and conditions of personal data protection and that you accept them in their entirety.
- You agree to these terms by checking the consent box on the online form. By checking the consent box, you confirm that you are familiar with the terms of the Privacy Policy and that you accept them in their entirety.
- The controller is entitled to amend these terms. The controller will publish the new version of the privacy policy on its website and will also send the new version of these terms to the email address you provided to the controller.
These terms take effect on February 25, 2020, with an amendment effective March 29, 2025, adding links to our partners’ privacy policies.
